Alta Title Endorsements Requested By Lenders In Relation To Alta Loan Policy of Title Insurance


Lenders request ALTA, CLTA and/or special endorsements to provide insurance against matters excluded or excepted from coverage. The American Land Title Association (ALTA) endorsements Lenders frequently request in relation to the ALTA Loan Policy of Title Insurance are:
a. 3.1-06 (Zoning – Completed Structure)
b. 6-06 (Variable Rate Mortgage)
c. 8.2-06 (Commercial Environmental Lien)
d. 9.3-06 (Restrictions, Encroachments, Minerals – Loan Policy)
f. 18.1-06 (Single Tax Parcel) or 18.2-06 (Multiple Tax Parcel)
g. 19.1-06 (Continuity, Single Parcel) or 19-06 (Contiguity, Multiple Parcels)
m. 28.1-06 (Encroachments – Boundaries and Easements)(on select transactions)
n. 35-06 (Minerals and Other Subsurface Substances – Buildings)
In addition, Lenders’ request “deletion of arbitration clause endorsement (SE-93).”
As Lender’s counsel on limited occasions, on behalf of Lenders we request individualized endorsements to meet the insured lender’s special needs in relation to a loan transaction.
